Terms of Service

1. Service description

Texalo provides a platform that automatically sends AI-generated SMS messages to callers who reach a business phone number and receive no answer. The service includes a dashboard for managing conversations and a manual reply feature.

2. Your account

You must provide accurate information when creating an account. You are responsible for maintaining the security of your login credentials. You must be at least 18 years old and operating a legitimate UK business to use the service.

3. Acceptable use

You may use Texalo only for legitimate business communications with people who have called your business phone number. You must not use the service to send unsolicited messages, spam, or any content that violates UK law including the Communications Act 2003 and the Privacy and Electronic Communications Regulations (PECR).

4. Your responsibilities as data controller

You are the data controller for your customers' personal data processed through Texalo. Texalo acts solely as your data processor. You are responsible for:

  • Ensuring you have a lawful basis for processing your customers' communications data
  • Configuring call forwarding on your own phone network
  • Compliance with PECR and UK GDPR in respect of your customers
  • Ensuring the AI persona settings do not mislead customers in a harmful way

5. Subscription and billing

The service is provided on a monthly subscription basis at £49.99 per month plus VAT where applicable. Billing is handled by Stripe. Your subscription renews automatically each month unless cancelled. You may cancel at any time through the Settings page in your dashboard.

6. 14-day money-back guarantee

If you are not satisfied within the first 14 days of your first subscription period, contact us at hello@texalo.co.uk for a full refund. This applies to first-time subscribers only.

7. Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused days after the 14-day guarantee period.

8. Limitation of liability

Texalo is a tool to assist with missed call follow-up. We do not guarantee that use of the service will result in recovered business or that all callers will respond. We are not liable for any lost business, revenue, or opportunities whether or not the service was operating correctly.

Our total liability to you for any claim arising from use of the service is limited to the fees paid by you in the 3 months preceding the claim.

9. Service availability

We aim for high availability but do not guarantee 100% uptime. Planned maintenance will be communicated in advance where possible. We are not liable for interruptions caused by third-party services (Twilio, Stripe, Anthropic) or events outside our control.

10. Changes to these terms

We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
